By accessing or using the InsureCheck platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.
InsureCheck provides an AI-powered insurance certificate processing and compliance verification platform. The Service enables organizations to upload, process, and analyze Certificates of Insurance (COIs) for compliance with coverage requirements. Features include document extraction, compliance rule evaluation, carrier intelligence, flood zone analysis, and reporting.
Access to the Service is by invitation only. You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account. You must notify InsureCheck immediately of any unauthorized use at security@insurecheck.io.
You may not share your account credentials, create accounts by automated means, or attempt to access accounts or data that do not belong to your organization.
You agree not to:
You retain all ownership rights to the documents and data you upload to the Service ("Customer Data"). You grant InsureCheck a limited license to process Customer Data solely as necessary to provide the Service. InsureCheck does not sell Customer Data to third parties.
InsureCheck owns all rights to the Service, including its software, algorithms, models, user interface, and platform infrastructure.
The Service uses artificial intelligence, including large language models, to extract and analyze information from documents. AI-generated outputs are provided as a processing aid and should be reviewed by qualified personnel before being relied upon for compliance decisions. InsureCheck does not guarantee the accuracy or completeness of AI-extracted data.
Each party agrees to keep confidential the other party's non-public information and to use it only for purposes of this agreement. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
InsureCheck will use commercially reasonable efforts to maintain Service availability. The Service is provided on an "as is" and "as available" basis. InsureCheck does not guarantee uninterrupted or error-free operation and is not liable for downtime resulting from scheduled maintenance, force majeure events, or circumstances beyond its reasonable control.
Subscription fees and payment terms are set forth in the applicable Order Form or Master Service Agreement. All fees are non-refundable except as expressly stated. InsureCheck reserves the right to suspend access for non-payment after reasonable notice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSURECHECK'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. INSURECHECK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You agree to indemnify and hold harmless InsureCheck and its officers, directors, and employees from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Either party may terminate the Service relationship upon the terms set forth in the applicable agreement. Upon termination, InsureCheck will retain Customer Data for 30 days to allow export, after which it may be permanently deleted. You may request earlier deletion by contacting support@insurecheck.io.
InsureCheck may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any disputes shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in English.
